The applicant has preferred this second bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.263/2020, registered at Police Station - Gurur, Dist. Balod (CG), for the offence under Section 498-A read with Section 34 of the Indian Penal Code.

Applicant was married with Ritu Gariha (since deceased) on 20-2-2019, however, on account of marital dispute she left the matrimonial house. Thereafter, the present FIR was lodged on 10-7-2020 alleging ill treatment constituting physical and mental cruelty.
4. Learned counsel for the State would oppose the bail application.

Considering the facts and circumstances of the case, particularly considering the fact that the applicant is in custody since 4-9-2020 for an offence which is triable by the Judicial Magistrate First Class and the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicant on regular bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
