Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 03/08/2017 Heard.

1. This petition is directed against order dated 04.12.2012 (Annexure P/1) by which in a departmental enquiry, the petitioner has been held guilty and penalty of removal from service has been imposed.

2. Learned counsel for the petitioner fairly submits that against an order of penalty, a departmental appeal has been preferred by the petitioner but as the appeal has not been decided till date, the petitioner was constrained to file this petition.

3. Learned State counsel submits that as the appeal has been preferred by the petitioner before the Additional Principal Chief Conservator of Forest (Non-Gazetted) in the office of Principal Chief Conservator of Forest of Chhattisgarh, the concerned authority may be directed to decide the appeal.

4. Having heard the submission of learned counsel for the parties, at this stage, it would be appropriate to direct that respondent No.2 shall ensure that appeal pending in his office is decided as early as possible. The appeal be decided within an outer limit of six months from the date of receipt of copy of this order.
