1. The present Contempt Petition has been filed alleging non-compliance of the Order dated 09.04.2019 passed in WPS No. 2615 of 2019.

2. Mr. Syed Majid Ali, counsel appearing for the Respondent No. 01 has filed his reply annexed as Annexure R-1/6 dated 28.08.2019, whereby the Divisional Forest Officer- Balod, Division-Balod has in the light of the Order of this Hon'ble Court cancelled the order of recovery and has also directed the concerned authorities to release his gratuity and monthly pension as per Rules.

3. Given the said fact of the Forest Divisional Officer, Balod, Division: Balod, this Court is of the opinion that the Order of this Court stands complied with. It is made clear, in case if the respondents have

deducted the amount, it shall be paid back or refunded to the petitioner forth-with. It shall not be recovered any further in the light of the order of this Court as well as the subsequent orders passed by the Divisional Forest Officer-Balod.

4. The petitioner/applicant would not be precluded from approaching this Court, if case, if there is still any dues left from the recovery made or for any other dues by way of a fresh proceeding.
