1. The present MCC has been filed seeking modification of the order dated 28.06.2018 passed in WPS No. 4197/2018, whereby this Court while disposing the writ petition has referred the status of the petitioner to have superannuated.

2. The counsel for the petitioner submits that the petitioner in fact has not superannuated and is still working. Accordingly to the petitioner, inadvertently the age of the petitioner was wrongly typed in the original writ petition that was filed.

3. Considering the said averments made by the counsel for the petitioner and taking note of the contents of the MCC, this Court is of the opinion that the petitioner has in fact made out a strong case for modification of the order. Accordingly in paragraph No.2 at line 4

where it has been observed by this Court that the petitioner stands superannuated and has not been given his retiral dues stands deleted.

4. Rest of the order would remain the same.

5. The MCC accordingly stands allowed and disposed off. Let the order passed in this MCC be made part of the Record of WPS No. 4197/2018.
