NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Criminal Revision No.813 of 2018 Smt. Mansi Singh, wife of Sunit Kumar Singh, aged about 40 years, resident of Nehru Nagar, Bhilai, Police Station Supela, District Durg, Chhattisgarh ---- Applicant versus Sunit Kumar Singh, son of Krishnanand Singh, aged about 52 years, Occupation Service, Posted as Head Assistant At Fairo Scrap Nigam India, Haridwar (U.P.), Resident of 87/5, Nehru Nagar (East), Bhilai, Supela, Tahsil and District Durg, Chhattisgarh --- Respondent For Applicant :

Shri B.P. Singh, Advocate For Respondent :

Shri Anurag Khatri, Advocate Hon'ble Shri Justice Arvind Singh Chandel Order on Board 12.12.2018 1.

With the consent of Learned Counsel appearing for the parties, the matter is heard finally.

2.

The instant revision has been preferred against the order dated 23.6.2018 passed by the Family Court, Durg in Case No.119 of 2017, whereby the Family Court has granted interim maintenance of Rs.1,500/- per month in favour of the Applicant/wife. 3.

It is not in dispute that the Applicant is the legally wedded wife of the Respondent and presently she is residing separately from him. As per pleadings of the Applicant/wife, the Respondent/husband is working as a Head Assistant in Fairo Scrap Nigam India, Haridwar and is getting monthly salary of Rs.65,000/-. It has been submitted on behalf of the Respondent/husband that after deductions, the Respondent is getting monthly salary of Rs.35,000/- only.

4.

Taking into consideration the monthly salary of the Respondent, I find that grant of interim maintenance of Rs.1,500/- per month to the Applicant by the Family Court is on much lower side. Therefore, the interim maintenance is enhanced from Rs.1,500/- per month to Rs.8,000/- per month payable to the Applicant/wife by the Respondent/husband with effect from the date of the impugned order, i.e., 23.6.2018.

5.

Consequently, the revision is allowed to the extent indicated above. Sd/- (Arvind Singh Chandel) Judge Gopal
