Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 16/08/2017 Heard.

1. Shri Anup Majumdar, Advocate, who usually appears as Panel Lawyer for CIDC is present in the Court.

2. The petitioner's grievance is that the petitioner's application for grant of compassionate appointment has remained pending.

3. It is submitted that the father of the petitioner, while working as peon in Chhattisgarh Infrastructure Development Corporation, died in harness on

-212.11.2015. He submits that in view of the policy decision taken by the Government on 19.07.2011 in such cases, the dependent of deceased employees are required to be considered for grant of compassionate appointment on the post of Shiksha Karmi Grade-III.

4. Learned State counsel did not dispute regarding applicability of circular dated 19.07.2011, he however, submits that the matter would require due consideration and scrutiny at the appropriate level in accordance with the procedure prescribed under the circular.

Clause 5 of the circular dated 19.07.2011 published in NRrhlx<+ deZpkjh ekxZn'kZd] Edition 2011 (lqfo/kk ykW gkml izk-fy-) shows that the application is required to be forwarded to the Collector for further enquiry and consideration. The application of the petitioner has already been forwarded to the Collector and representations have also been made to the Collector. Therefore, in these circumstances, the Collector is required to take necessary steps, if any already not taken, in accordance with clause 5 of circular dated 19.07.2011 to ensure that the petitioner gets the benefit to which he may be entitled, if otherwise, qualified and eligible, within an outer limit of 4 months. The petitioner shall submit a copy of this order before the respondent No.2 & 4 for necessary compliance.

6. The petition is accordingly disposed off.
