1. Learned counsel for the respondents would submit that the dispute can be resolved by intervention of the Engineer-in-Chief as provided in clause 12 of terms and conditions of the contract dated 8.7.2007.

2. Learned counsel for the petitioner would submit that the petitioner may be allowed to raise a dispute before the Engineer-in-Chief as

provided in clause 12 of the terms and conditions of the contract dated 8.7.2007.

3. Be that as it may, the petitioner is at liberty to raise a dispute as provided in clause 12 of the contract before the Engineer-in-Chief within two weeks from today. If such a dispute is raised, the Engineer-in-Chief shall consider and decide the same expeditiously strictly in accordance with law without being influenced by the order dated 22.6.2017.

4. With the aforesaid observation, the writ petition finally stands disposed of. No cost(s).
