1. The applicant has preferred this bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.170/2020, registered at Police Station Sakari, District Bilaspur (C.G.) for the offence punishable under Section 457, 380 of the Indian Penal Code.
2. Applicant alongwith co-accused Devendra Toder have committed theft of ornaments and cash total amounting to Rs. 7,18,000/- from the house of complainant Shashikant. Bail application of Devendra Toder bearing MCRC No.5535 of 2020 has been dismissed as withdrawn.
3. Learned counsel for the applicant submits that there are more than one case against the co-accused Devendra Toder and whereas the
MCRC 8241 of 2020 present applicant is first offender and he is in jail for the last almost eight months and the charge sheet has already been filed.
4. Learned State counsel would oppose the prayer for grant of bail.
5. Considering the length of pre-trial detention and for the fact that charge sheet has already been filed and also the applicant is first offender, I am inclined to release the applicant on bail.
6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
