1. Counsel for the petitioner makes a limited request that as of now the grievance of the petitioner would be redressed if the respondents are directed to consider and decide his representation.

2. The petitioner seems to be the aggrieved by the non granting of promotion to the petitioner from the post of Senior Agriculture Development Officer to the post of Assistant Director Agriculture.

3. Contention of the petitioner is that many of the persons who were placed below the petitioner in the gradation list have already been promoted on the post of Assistant Director vide promotion order dated 15.09.2020. It is

-2thereafter that the petitioner immediately started making representations to the respondents for considering the claim of the petitioner also for promotion to the post of Assistant Director. However, the same was till date pending and therefore he wants suitable directions to the department to take early decision particularly taking note of the fact that only a short period of service is left for the petitioner to retire.

4. The limited prayer is not opposed by the State counsel. However, it is contended that claim of the petitioner shall be decided purely on its own merits in accordance with the rules and regulations governing the field of promotion.

5. In view of the same, the writ petition stands disposed of and respondents are directed to consider and decide the representation of the petitioner which he has made so far as ignoring of the petitioner's seniority for promotion to the post of Assistant Director.

6. Let an appropriate decision be taken by the respondents at the earliest preferably within a period of 90 days from the date of receipt of copy of this order.
