1. Heard counsel for the parties.

2. The petitioner has preferred this writ petition seeking relief to direct the respondents to consider his case for grant of upgradation as per circulars dated 17/03/1999, 19/04/1999, 17/05/2000, 28/04/2008 and 04/08/2010 along with 18% per annum interest to grant delayed payment.

3. The petitioner is Chief Executive Officer posted at Janpad Panchayat, Dondi, District Balod (C.G.).

4. Counsel for the petitioner would submit that the petitioner may file fresh representation before the respondent No. 1 and this writ petition may be disposed of directing the respondent No. 1 that he must decide such representation within stipulated time.

5. Looking to the facts and circumstances of the case and submission made by the counsel for the petitioner, the instant writ petition is disposed of with this direction that the petitioner may file fresh representation within 10 days from today. If such representation is filed, then the respondent No. 1 shall dispose of the same expeditiously and preferably within a period of 90 days from the date of receipt of such representation, according to law and procedure.

6. It is made clear that this Court has not expressed any opinion on the merits of the case.
