Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 08/09/2016 Though, by this petition, the petitioner has challenged the order of dismissal from service in a departmental enquiry and non-consideration of his appeal against penalty order on the ground of pendency of State's appeal against acquittal, in view of subsequent developments that the appeal against acquittal has been dismissed by this Court, a prayer is made that the petition may be disposed off with a direction to decide the departmentalappeal which is pending before the appellate authority.
State counsel does not oppose this prayer.
In view of changed circumstances, no useful purpose would be served in keeping this petition pending.
Accordingly, this petition is finally disposed off with a direction to decide the appeal within a period of four months from the date of receipt of copy of this order.
