Shri Agrawal, learned Counsel for the Petitioner, at the outset makes a limited prayer for a direction to Respondent No.2 to consider the case of the Petitioner as to whether he is entitled for promotion or not. He submits that to this effect the Petitioner has already made a representation to Respondent No.3, Chief Municipal Officer, Municipal Council Bade Bacheli on 31.01.2015 (Annexure P-6) which is yet to be decided. He thus prayed that the present writ petition may be disposed of with a

direction to Respondent No.2 to consider the case of the Petitioner in accordance with the laws and rules applicable and to take a decision as expeditiously as possible. 2.

The said prayer of the Counsel for the Petitioner is not opposed by the Counsel for the State.

In the given facts and circumstances of the case, the present writ petition is disposed of with a direction to Respondent No.2 to take a decision on the representation made by the Petitioner routed through the office of Chief Municipal Officer, Municipal Council Bade Bacheli. In case, if for any reason the representation put forth by the Petitioner has not been forwarded, it is expected that Respondent No.3 shall immediately forward the same to Respondent No.2 and on receipt of which the Respondent No.2 in turn shall take a decision promptly within a period of four months from the date of receipt of the said representation, in accordance with the rules and laws governing the field.
