1. The claim of petitioner in the present writ petition is for an appropriate direction to the respondents to grant the benefit of family pension to the petitioner on the death of her husband who died in harness while working under the respondent no.2.

2. Shri Sandeep Dubey, advocate, appearing on advance copy, on behalf of respondent no.2, submits that let the writ petition itself be disposed of directing the respondent no.2 to scrutinize the claim of petitioner, subject to her entitlement part being verified, an appropriate decision be taken at the earliest.

3. Given the submissions made by the counsel for the parties, particularly respondent no.2, the writ petition at this juncture stands disposed of directing the respondent no.2 to immediately process the claim of petitioner and subject to her being found entitled and eligible for family pension on the death of her husband who died on 28.09.2013 working under the respondent no.2 as a Safai Kamgar, the family pension be released to the petitioner with arrears up till date, within a period of 4 months from the date of receipt of copy of this order. In case the petitioner is found ineligible for family pension, let an appropriate communication in this regard be made with the petitioner giving reason for the petitioner not being entitled for the same.

4. The writ petition stands disposed of.
