Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 25/08/2017 The transfer order has been challenged by the petitioner on the ground that the wife and son of the petitioner, both are suffering from Thalassaemia desease which requires frequent blood transfusion and if the petitioner is transferred to Gidam, they may not get this facility at Gidam or nearby place. 2.

Looking to the nature of illness stated in the petition, it would be appropriate to direct consideration of representation after taking medical opinion in the matter and also taking into consideration whether shifting of the petitioner would affect treatment of his wife and son, because the son is stated to be around 26 years of age. 3.

Against the transfer order, the petitioner will have to file representation within 10 days from today and the same shall be decided by the respondents within three weeks from the date of receipt of representation. Till decision on representation is taken by the respondents, coercive steps shall not be taken against the petitioner to compel him to proceed on transfer.

The petition is accordingly disposed off.
