1. The transfer order is under challenge on the ground that in the past for about 8 years, the petitioner had remained posted in scheduled area and now the petitioner is again being transferred to Bijapur which is core scheduled area.

2. Upon being enquired, learned counsel for the petitioner submits that the petitioner has remained posted at Raigarh for the last 5 years. If that be so, there is nothing in the policy which mandates that in such case the petitioner

should necessarily be considered for posting in non scheduled area.

3. The other ground of personal difficulty raised by the petitioner.

4. This ground can be best examined only by the competent authority not by this Court. Therefore, this petition is disposed off with liberty to file representation.

5. If the petitioner is made representation, the same shall be considered and decided within a period of four weeks from the date of submission of representation.
