1. At the outset, learned counsel for the appellant seeks to withdraw the appeal with liberty to take appropriate remedy as may be available to the appellant under the law for setting aside the ex-parte judgment and decree of divorce.

2. Considering the prayer, we are inclined to permit the learned counsel for the appellant to withdraw the appeal with liberty as prayed for.

3. With liberty as prayed for, the appeal is dismissed as withdrawn.
