Petitioner who is present in person submits that the petitioner is a Teacher and he was suspended on 02.04.2013 and was subsequently reinstated on 05.10.2015 and his salary was stopped. It is stated that the respondent is the office bearer of Education Department who sanctions the grant in aid for the school from State. It is stated that deliberate delay was committed for release of payment of the salary, therefore, offence is committed under Section 22-A(c) of the Chhattisgarh Vinirdist Bhrast Aachran Niwaran Adhiniyam, 1882 wherein the punishment is contemplated for delayed payment of the salary or withholding it without any rhyme and reason.

In any case the petition has been directly preferred before the High Court, neither any report has been made to the police nor any complaint is filed before any Court. Consequently, this Court is not inclined to entertain this petition, as the petitioner is at liberty

to approach to the concerned police authorities or otherwise may avail the remedy of filing the complaint before the appropriate forum subject to just exception. Therefore, at this stage, I am not inclined to entertained this petition. Accordingly, it is dismissed. Ashok Sd/- (Goutam Bhaduri) Judge
