Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 15/01/2021

1. This is an application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.278 of 2020, registered at Police Station Khamtrai, District- Raipur C.G. for the offence punishable under Section 307/34 of the I.P.C.

2. The present applicant along with Dayashankar Sahu and Anil Kumar Lahre (juvenile) has attempted on life of injured Prakash Vishwas. The allegation of causing injuries is on

MCRC No. 7463 of 2020 Dayashankar Sahu who has already been allowed regular bail by this Court in MCRC No.6587 of 2020 decided on 29.10.2020.

3. Learned State counsel would oppose the prayer for grant of bail.

4. Considering that main accused Dayashankar Sahu has already been released on bail, I am inclined to release the applicant on bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
