Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 30/10/2017

1. The petitioner who is working as Senior Agriculture Development Officer has been transferred to two different places by which the two different orders passed on even date.

2. By first order he has been referred as Senior Agriculture Development Officer transferring him from Pali District Korba to Odagi District Surajpur.

3. By the second order of the same date the petitioner has been shown to be working as Rural Agriculture Extension Officer and has been transferred from Pali to the Office of Deputy Director Agriculture, Raigarh.

4. By interim order dated 30.08.2017, the orders have been stayed.

5. Considering the fact that the petitioner's designation is different in both the orders but there exists two such orders, where the petitioner's name is reflected, it would be appropriate if the State Government decides the issue by considering the petitioner's representation.

6. Accordingly, the writ petition is disposed of with a direction that in the event petitioner prefers representation before the State Government within a period of four weeks from today, the State Government who has passed the transfer orders shall consider and decide the representation at the earliest preferably within a period of three months from the date of submission of application.

7. Till the matter is decided by the State Government the interim order granted earlier shall continue. Sd/- Judge Prashant Kumar Mishra Akhilesh
