1. The transfer order is under challenge on the ground that even though the petitioner has remained posted at Korba, which is a scheduled area for last 27 years, when an occasion arose for transfer, she has again been posted in a scheduled area at Jashpur.

2. It is found that under the policy dated 3.6.2015, where a person has remained posted in scheduled area, the policy requires that when an occasion arises for transfer, he/she should be considered posting outside the scheduled area. Therefore, to that extent, the petitioner is entitled to consideration. It is found that representation has not been made to the authority. If the petitioner prefers representation within a period of 15 days, the same shall be considered and decided within a period of 4 weeks and for a period of 6

-2weeks, no coercive steps shall be taken against the petitioner to compel her to proceed on transfer.
