Hon'ble Shri Justice Goutam Bhaduri Order 28-10-2020

1. Heard.

2. Learned counsel for the petitioner would submit that the present petition is preferred for setting aside the order dated 14-9-2020 (Annexure P/1) whereby the petitioner has been suspended. He would further submit that the petitioner has already filed an

appeal with all relevant documents and the same may be directed to be considered and decided by the appellate forum, at the earliest.

3. In relief clause of the writ petition no such whisper has been made and instead it has only been prayed that suspension order dated 14-9-2020 (Anenxure P/1) may be set aside and further the representation filed by the petitioner may be considered.

4. When an appeal has already been filed by the petitioner before the appropriate forum, as stated, this court will not step into the shoes of supervisory authority of appellate forum and direct to consider the particular fact. It is for the appellate forum before whom the statutory appeal has already been filed, to consider the submissions and documents submitted by the petitioner. The petition is, therefore, completely misconceived.

5. Accordingly, the writ petition being devoid of merit is liable to be and is hereby dismissed.
