1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 11.06.2021 in connection with Crime No. 36/2021 for the offence punishable under Sections 4 & 5 of the Explosive Substances Act and Section 8 (3) of the C.G. Vishesh Jan Suraksha Adhiniyam, registered at Police Station- Manpur, DistrictRajnandgaon (C.G.).

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file appropriate application before appropriate Bench.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn with the

liberty as stated above.

6) Registry is directed to return the certified copy of the impugned order to the counsel for the applicant on his furnishing true authenticated photocopy of the same.
