At the outset it is submitted that the petitioner has challenged the order of penalty on other grounds including jurisdiction and quantum both. It is submitted that the appeal has remained pending. 2.Without commenting upon the merits of the case it is observed that the petitioner has already preferred an appeal the same shall be considered and decided within a period of four months. Accordingly this petition is finally disposed off.
