Writ Appeal No.420/2019 was dismissed for want of prosecution on 19.08.2021 as none had appeared for the appellant from 16th August, 2021 to 19th August, 2021 when the matter was called out for final hearing. MCC No. 497/2021 is an application by which prayer is made to restore the appeal. 3.

Mr. Sharma submits that he was suffering from fever and cold and later on it transpired that he was suffering from Typhoid. Due to illness, there

was also oversight in scanning the cause-list and in the said circumstances, no steps could be taken on behalf of the appellant. 4.

Dr. Saurabh Kumar Pande, learned counsel appearing for respondents No.1 & 2 has no objection for restoration of the appeal. 5.

Accordingly, the order dated 19.08.2021 is re-called and the Writ Appeal No. 420/2019 is restored to its original number. 6.

MCC stands disposed of. Registry will list the appeal for hearing in the month of February, 2022.
