Nakul Ram Sinha v. Shri Rajendra Jha
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR CONT No. 429 of 2015
1. Nakul Ram Sinha S/o Shri Late Laxman Ram Sinha, Aged About 42 Years R/o Village- Albelapara, Kanker, Post, Thana, Tahsil, Block And District- Kanker (Chhattisgarh) ---- Petitioner
Versus
1. Shri Rajendra Jha , District Education Officer, Kanker, District- Kanker (Chhattisgarh)
2. Shri Sankalp Sahu, Assistant Commissioner, Tribal Welfare Department, Kanker, District- Kanker (Chhattisgarh) ---- Respondents For Petitioners.
: Shri Somkant Verma, Advocate.
Order On Board 10/09/2015 Heard.
1.
This contempt petition has been filed alleging willful disobedience of order dated 10.09.2014 passed in the writ petition.
2.
The submission of learned counsel for the petitioner is that a direction was given to respondent no. 2 to decide the claim of the petitioner within a period of 2 months from the date of receipt of copy of the order. Presumably the respondent no. 2 has not decided the matter as the mother in law of the petitioner has also filed a petition challenging the consent letter dated 06.12.2014 issued by the respondent no. 2. 3.
Considering that respondent no. 2 had passed an Order on 06.12.2014 in compliance of the Order passed by this Court on 10.09.2014, it can not be said that he is
acting in willful disobedience at this stage, therefore, I am not inclined to issue any direction to respondent no. 2. The contempt petition is at this stage, dismissed with a liberty to revive at appropriate stage.
4.
The petition is therefore, dismissed.
