Heard on the application for condonation of delay in filing the application for restoration of MA No.887 of 2006.

After considering the ground mentioned in the application, the same is allowed and the delay in filing the MCC is condoned. 3.

Heard on the application for restoration of Miscellaneous Appeal No.887 of 2006.

On the basis of the ground mentioned in this MCC and for the reason that the respondent was also not present on the date the case was dismissed for non-prosecution, I feel inclined to allow this application. 5.

Consequently, the MCC is allowed and MA No.887 of 2006 dismissed for want of prosecution on 18-04-2019 is restored to its original number. 6.

The petition is disposed off.
