Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 26/09/2017 Heard.

1. The impugned order dated 04.08.2017 has been challenged by the petitioners mainly on the ground that the promotion order of the petitioners has been cancelled without affording any opportunity of hearing.

2. Learned State counsel would fairly submit that if that is the ground, the respondents shall not give effect to the impugned order but shall only proceed in accordance with law to first issue a notice to the petitioners, afford them an

opportunity of hearing and then take decision in accordance with law.

3. In view of the above statement made by learned State counsel, the impugned order is set aside though with liberty to the competent authority to issue notice, afford an opportunity of hearing and then take appropriate decision in the matter.

4. The petition is accordingly disposed off.
