1. This is first bail application of the applicants under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to them as they have been arrested by the police in connection with Crime No.102/2019 registered at O.P. Chichola, Police Station-Chhuria, District-Rajnandgaon(C.G.) for the offence punishable under Section 34(2) of the Chhattisgarh Excise Act, 1915.

2. Learned counsel for the applicants submits that applicants are innocent and have been falsely implicated in this case. The applicants are transporter and they were transporting the goods on the order

Page No.2 placed by Raju @ Bhuwan Mahar. The applicants are in jail since 2.6.2019, hence, it is prayed that they may be enlarged on regular bail.

3. Learned State counsel opposes the bail application and submissions made in this respect.

4. Heard both the parties and perused the case diary.

5. In total 315 litres foreign liquor was seized from the possession of these applicants when the same was being transported in a car. Hence, this case.

6. Considering the entire material present in the case diary, I feel inclined to allow the application of these applicants.

7. Accordingly, the bail application filed under Section 439 of Cr.P.C. is allowed. It is directed that the applicants shall be released on regular bail on their furnishing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned trial Court, for their appearance as and when directed.
