1. The petitioner has preferred this writ petition to quash order dated 08.06.2018 (Annexure P-1) issued by respondent No.3 for promotion of the private respondent i.e. respondent No.4 for the post of Head Master Middle School and to direct respondent No.2 to grant him promotion as Head Master Middle School, one day before, when his junior employee has been promoted as Head Master Middle School with all consequential benefits and to

decide his pending representation, which is part of Annexure P-5, received on 11.06.2018.

2. The petitioner is working as Upper Division Teacher and posted at Government Middle School Shuklabhata, Block Balodabazar, District Balodabazar-Bhatapara.

3. Counsel for the petitioner would submit that the instant writ petition may be disposed of by giving direction to respondent No.3 to decide his pending representation, which is part of Annexure P5 within a stipulated time.

4. Looking to the facts and circumstances of the case and submission made by the counsel for the petitioner, the instant writ petition is disposed of with this direction that respondent No.3 shall consider and decide the pending representation of the petitioner Annexure P-5 expeditiously preferably within a period of 90 days from the date of receipt of certified copy of this order in accordance with law and procedure and considering all consequential benefits.

5. It is made clear that this Court has not expressed any opinion on the merits of the case.
