Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 10/10/2017 Heard.
1. This petition has been filed by the petitioner for quashing the remarks communicated to the petitioner vide memo dated 07.09.2017.
2. It is submitted that the remarks given against the petitioner are vague and not very specific. Therefore, the petitioner is not in a position to submit specific comment and representation for improvement of his remarks given to him. In support of submission, learned counsel for the petitioner relies upon the decision of the Supreme Court in the case of State of U.P. Vs. Yamuna Shanker Misra and another, 1997 (4) SCC 7.
3. The remarks which have been communicated to the petitioner, grade the petitioner as average (C) on the basis of the observation made by the Additional Registrar of the Establishment. The petitioner has filed this petition without making any representation to highlight why he is entitled to a better grading on the basis of his performance. Therefore, at this stage, I am not inclined to entertain this petition. The petition is therefore dismissed with liberty to the petitioner to prefer representation.
