Versus

1. State Of Chhattisgarh Through The Secretary, Revenue And Disaster Management Department, Mahanadi Bhawan, Mantralaya, New Raipur, Chhattisgarh

2. The Collector, District Bilaspur, Chhattisgarh

3. The Tahsildar, Marwahi, District Bilaspur, Chhattisgarh

4. The Tahsildar, Pendra, District Bilaspur, Chhattisgarh

5. The Tahsildar, Kota, District Bilaspur, Chhattisgarh ---- Respondents For Petitioner :

Mr. Basant Dewangan, Advocate For State :

Ms. Sunita Jain, Panel Lawyer Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 06/10/2017 Heard.

The petitioner has filed this petition aggrieved by order dated 22.08.2017 issued by respondent No.2.

2. Learned counsel for the petitioner submits that the State Government transferred the petitioner on his own request to Tahsil Kota. Therefore, he could be posted only within the Tahsil Kota, District Bilaspur but after the order of the State Government, the Additional Collector, Pendraroad passed an order on 22.08.2017, posting of the petitioner as Peon in Tahsil Office, Marwahi, which is contrary to the order of the State Government. Thereafter, the Tahsildar Marwahi has passed the order requiring petitioner to join in the office of Additional Collector, Pendraroad.

3. In view of the State Government's order dated 14.08.2017, order 22.08.2017 and 07.09.2017 are clearly illegal and without authority. It appears that the Additional Collector Pendraroad and Tahsildar Marwahi are not aware of the order of the State Government. According to the order of the State Government, the petitioner is to be posted in Tahsil Kota.

4. In view of the above, the Tahsildar Marwahi is directed to relieve the petitioner to join in the office of Tahsildar Kota and Tahsildar Kota shall issue appropriate posting order of the petitioner within his own Tahsil.

5. The petition is accordingly disposed off.
