Admittedly, petitioner's pension case was finalized by the committee formed in pursuance of the order passed by this Court on 07.05.2009 in WPS No.4563/2006 in Abdul Nawab Khan and others vs The State of Chhattisgarh and others, however, thereafter the pay was revised and the amount for which the petitioner is entitled has been reduced.

The subsequent reduction in the pension/pay scale is a fresh cause of action, for which the petitioner is required to file fresh writ petition, as in the earlier writ petition, this Court had not examined the correctness of reduction in pay scale, which had

not arisen at that point of time.

In view of the above, the notice issued to the respondent is discharged. The contempt petition is disposed of reserving liberty in favour of the petitioner to move a fresh writ petition. Sd/- Judge Prashant Kumar Mishra Nirala
