1. Heard on application (I.A. No.1) for condonation of delay in filing the appeal.

2. Upon due consideration of the cause shown in the application and the period of delay, we are inclined to condone the delay in filing the appeal.

3. Accordingly, the application is allowed. Delay of 43 days is condoned.

4. After arguing for sometime, in view of the impugned judgment and decree being an ex parte one, learned counsel for the appellant seeks to withdraw this appeal with liberty to move appropriate application for setting aside ex parte decree.

5. Accordingly, with the liberty as prayed for, the appeal is dismissed as withdrawn.
