Delay in finalizing the pension case and release of balance retiral dues have brought the petitioner before this Court.

From the documents, which have been filed and the pleadings made in the petition, it is found that the departmental enquiry was pending, in which, final order was passed and recoveries have been made. There were certain excess withdrawal from the GPF Account, which along with interest has already been deposited by the petitioner. The petitioner has filed memo dated 06-04-2017 sent by the Chief Executive Officer, Janpad Panchayat, Bagicha, by which, he has requested for return of the service book of the petitioner for finalization of pension case of the petitioner. Six moths have elapsed and it appears that because of non-availability of service book, pension case of the petitioner could not be finalized by the Chief Executive Officer, Janpad Panchayat, Bagicha. 4.

Considering that the petitioner is a retired employee, and now for want of service book, pension case has not been finalized, direction is issued to respondent No.2 to send back the service book of the petitioner to the Chief Executive Officer, Janpad Panchayat, Bagicha, if not already sent, within a period of 15 days from the date of receipt of a copy of this order. Thereafter, within a period of two months, the Chief Executive Officer, Janpad Panchayat, Bagicha shall finalize the pension case of the petitioner and settle all the dues by making payment including arrears of pension. 5.
