The grievance of the petitioner as ventilated through this petition is arising on account of non-payment of gratuity and insurance claim. 2.

The petitioner was proceeded against the departmental enquiry and penalty of compulsory retirement was imposed on him. The petitioner's claim is not based on the provision contained in the Chhattisgarh Civil Services (Pension) Rules, 1976 which are applicable to the State Government servant. The petitioner has an efficacious and alternative remedy of filing an appeal under the provision of the Cooperative Societies Act to raise all the claim as the petitioner is a retired employee of Cooperative Bank. Therefore, reserving liberty to the petitioner to file an appeal, the writ petition is dismissed.
