NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Writ Appeal No. 411 of 2016 Shanti Lal Sahu S/o Shri Gahiru Ram Sahu, aged 44 years, Working as Patwari, At PH No. 15, Ghoghopuri, Tehsil Gurur, District Balod, Chhattisgarh. ---- Appellant
Versus
1. State of Chhattisgarh, Through its Secretary, Department of Revenue and Disaster Management, Mantralay, Mahanadi Bhawan, Naya Raipur.
2. The Collector, District Balod, Chhattisgarh.
3. The Joint Collector, District Balod, Chhattisgarh.
4. The Tehsildar, Tehsil Guru, District Balod, Chhattisgarh. ---- Respondents For Appellant : Shri R.K.Kesharwani, Advocate.
For Respondents/State : Shri Vinod Deshmukh, Deputy Government Advocate. Hon'ble Shri Deepak Gupta, Chief Justice Hon'ble Shri Sanjay K. Agrawal, J.
Order on Board Per Deepak Gupta, Chief Justice 06/09/2016 1.
This appeal is directed against the judgment dated 11.08.2016 passed in Writ Petition (S) No. 3654 of 2016 whereby the petition filed by the Appellant/Petitioner against his transfer has been dismissed. 2.
The main ground raised is that the Appellant/Petitioner has been transferred during the ban period without approval of the Hon'ble Minister. 3.
As noticed by learned Single Judge, the Appellant/Petitioner has only been shifted from one Patwari Halka to another Patwari Halka within the same Tahsil. Even his headquarter has not been changed. He is virtually
within the same area. Transfer is an exigency of service and no government servant has a right to claim that he may remain posted at one station for the whole life.
4.
We therefore find no merit in this appeal. It is dismissed. Sd/- Sd/- (Deepak Gupta) (Sanjay K. Agrawal) CHIEF JUSTICE JUDGE Anu
