Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 27-07-2020 in connection with Crime No.118/2020 registered at P.S. - Outpost - Damapur, P.S. Kunda, District Kabirdham, Chhattisgarh for the offence under Section 420, 467, 468, 471, 201/34 of the IPC.

It is submitted by learned counsel for the applicant that the applicant has been falsely implicated in this case. Similarly placed co-accused Bhagwati Bai, Vidyacharan @ Prakash Jangde, Kaushal Barman have been granted bail by coordinate Bench of this Court. Case of the applicant is also similarly placed. Therefore, it is prayed that the applicant be granted bail. 3.

Learned counsel for the State/non-applicant opposes the application. 4.

Heard learned counsel for the parties and perused the documents. 5.

The FIR has been lodged by complainant Bhago Bai alleging that forged documents of Rin Pustika, B-1, Khasra Panchshala etc. were obtained by the applicant and other co-accused persons which were used by them to open a bank account in Allahabad Bank, Pandaria for getting sanction of the KCC

-2Loan, out of which the applicant and other co-accused withdrew Rs. 1,65,000/-. 6.

Considered on the submissions. For the reason that the co-accused persons have been granted bail I feel inclined to allow this application. 7.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on his furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for his appearance as and when directed. 8.
