Heard on I.A. No.1 of 2021, 8th bail application for grant of interim bail.

The applicant is arrested in connection with Crime No.329/2019 registered at P.S. Kawardha, District- Kabirdham, Chhattisgarh for the offence under Sections 376, 506 and 120-B, 34 of I.P.C.

It is submitted by the counsel for the applicant, that all the 6 previous applications of the applicant have been rejected out of which, M.Cr.C. No. 2753 of 2020 was dismissed on merits on 22.6.2020, however, the applicant was granted temporary bail in M.Cr.C. No. 8829 of 2020 by order dated 2.12.2020 on the

ground for appearing in the examination. The present application for interim bail has been again filed on the same ground praying that the supplementary examination is scheduled from 17.9.2021 to 30.9.2021. The applicant has submitted the form for appearing in this exam although, he has not received admit card so far, but the same will be available to the applicant before the scheduled day of examination, hence, it is prayed that limited bail for appearing in the examination of Class-XII of the Chhattisgarh Board be granted in favour of the applicant.

Learned counsel for the State/respondent opposes the bail application and the submissions made in this respect. Heard counsel for both the parties and perused the case diary.

Considering the fact that the earlier bail application was allowed on similar ground in M.Cr.C. No. 8829 of 2021, hence, only for the reason that the future prospects of the applicant may not be destroyed, therefore, I feel inclined to grant temporary bail to the applicant.

Consequently, I.A. No.1 of 2021, an application for temporary bail is allowed to appear in the examination of the subjects which the applicant has opted.

It is directed that the applicant shall be released on temporary bail on furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, till the date fixed for his surrender before

the concerned Court. The applicant shall surrender before the concerned Court on 27 th September, 2021.

The application for regular bail is also disposed off. Certified copy of the order today.
