Jagdish Prasad Khare v. State Of Chhattisgarh
NAFR HIGH COURT OF CHHATTISGARH, BILASPUR Writ Appeal No.457 of 2015 Jagdish Prasad Khare, S/o Shri Tulsi Ram Khare, aged about 44 years, Assistant Grade-2, Tahsil Office Korba, R/o NH-12, New Rajswa Colony, Rampur, Korba, District Korba, Chhattisgarh ---- Appellant versus
1. State of Chhattisgarh through Secretary, Revenue and Disaster Management Department, Mahanadi Bhawan, Naya Mantralaya, New Raipur, Chhattisgarh
2. Commissioner, Bilaspur Division, Mungeli Naka, Bilaspur, District Bilaspur, Chhattisgarh
3. Collector, Korba, District Korba, Chhattisgarh
4. Tehsildar, Tehsil Korba, District Korba, Chhattisgarh ---- Respondents For Appellant : Shri Jitendra Shrivastava, Advocate For Respondents/State : Shri B. Gopa Kumar, Deputy Advocate General Hon'ble Shri Navin Sinha, Chief Justice Hon'ble Shri Justice P. Sam Koshy Judgment on Board Per Navin Sinha, Chief Justice 23/9/2015 1.
The present appeal arises from order dated 9.9.2015 dismissing Writ Petition (S) No.3294 of 2015.
2.
Learned Counsel for the Appellant submits that his place of posting is at Korba and he has wrongly been shown as transferred from Barpali. It was next submitted that he is the Vice-President of the Workers Union. These aspects of the matter have not been considered appropriately. 3.
Learned Counsel for the State submits that in the earlier writ petition this Court had directed the Collector to consider his representation. It has been disposed by a speaking order that the Appellant was only attached to
the office at Korba while he was substantively posted at Barpali. The circular dated 24.4.1996 does not include Vice-President of the Union. 4.
We find no reason to interfere with the order of the Learned Single Judge in a matter relating to transfer and posting aptly holding that unless there was any mala fide or violation of the statutory provisions or otherwise adversely affected the service conditions of an employee, it warranted no interference.
5.
The writ appeal is dismissed.
