Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 14/09/2016

1. The present writ petition has been preferred by complainant of Criminal Case No.62/95 pending in the Court of CJM, Durg for a direction to the trial Court to expedite the trial.

2. It appears, on petitioner's complaint, offence has been registered against the respondents under Sections 420, 467, 468, 471 and 120-B of the IPC on 1.8.1995 and since then trial is pending in the Court of JMFC, Durg or CJM, Durg.

3. A reading of the order sheet of the trial Court recorded on 12.7.2011 would further indicate that on earlier occasion also, this Court has issued direction for early conclusion of trial.

4. Considering the fact that the trial is pending for the last 20 years, the Writ Petition is disposed of with a direction to the trial Court to make all possible endeavour to conclude trial of Criminal Case No.62/95, at the earliest, preferably within a period of 8 months from the date of submission of certified copy of this order. Any violation of this order regarding disposal of the case within outer time limit shall be viewed seriously and it may reflect on the Annual Confidential Report of the Presiding Officer of the trial Court.
