1. Heard.

2. These are the two applications filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.88/2019 registered at Police Station Charama, District U.B. Kanker for the offence punishable under Section 306/34 of the IPC.

3. Deceased Chameli was married with applicant Bhavesh Tandon about 1 1⁄2 years prior to the date of the incident. The deceased set herself ablaze on 22.12.2016 and eventually, succumbed to the burn injuries on 29.12.2016.

4. Material available in the case diary indicates that the applicants were demanding funds for purchasing cows and oxes. Applicant Bhavesh Tandon was otherwise also committing cruelty by alleging that the deceased is not properly performing the household work.

5. Considering that there is no allegation of demand of dowry as the concerned Police Station has not registered offence under Section 304-B of the IPC and for the fact that the applicants are in jail since 16.9.2020 and the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicants on regular bail.

6. Accordingly, the bail applications are allowed and the applicants are directed to be released on bail on each of them furnishing a personal bond for a sum of Rs.50,000/- with one surety each in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
