With the consent of the learned counsel for the parties, the matter is heard finally.

The petitioner is aggrieved by the order passed by the Chief Executive Officer, Balod on the basis of recommendation of the General Administration Committee of the said Janpad posting the petitioner from Primary School, Baghmara to Primary School, Sohtara within the same Janpad.

Learned counsel for the petitioner would submit that the impugned order is infact a transfer order, however, because of ban imposed on transfer, the impugned order is illegal.

Let the petitioner prefer a representation before the Jila Panchayat, Balod within a period of 15 days from today, which shall be considered and decided by the said authority within a further period of 6 weeks. Sd/- JUDGE PRASHANT KUMAR MISHRA Nirala
