Mr. Basant Kaiwartya, Advocate For State :
Mr. Raghvendra Verma, G.A.
Hon'ble Shri Justice P. Sam Koshy Order on Board 16/10/2020 1.
The limited relief that the petitioner has sought for in the present writ petition is for an appropriate direction to the respondent No.4 to take a decision on the application filed by the petitioner in respect of the alleged illegal encroachment made by the respondent No.4 on the public road, which otherwise is a government land. 2.
Mr. Raghvendra Verma, the learned State counsel submits that because of the intermittent Lock-down and the effect of the COVID-19 pandemic appropriate decision could not be taken. He however
submits that the decision shall be taken at the earliest hopefully within a period of 4 weeks.
3.
As submitted by the State counsel this Court is of the opinion that the writ petition need not be kept pending any further. The writ petition is accordingly disposed of directing the respondent No.2 to take a decision in accordance with law at the earliest preferably within a period of 6 weeks from the date of receipt of the copy of this order. 4.
It is made clear that we have not expressed any opinion on the merits of the case. The respondent No.2 shall take a decision purely on its merits in accordance with law after hearing all the affected parties to the dispute.
5.
With the aforesaid observations, the present writ petition stands disposed of.
