The present contempt petition has been filed alleging non compliance of the order dated 19.08.2019 passed in WPS No.6235 of 2019. The operative part of the order shows that a direction was given to the respondents to take an appropriate decision on the claim of the petitioner. Along with contempt petition, the petitioner has enclosed a copy of order passed by the respondent department dated 05.12.2019 whereby the claim of the petitioner has been rejected.

Once when the order passed by this court was for taking an appropriate decision and the respondents having taken a decision on 05.12.2019, this court is of the firm view that the order/direction given by this court stands duly complied with. However, in case, if the petitioner was not satisfied with the outcome of the said order, the petitioner had an opportunity of assailing the same by way of a fresh writ petition. The veracity of the said order cannot be tested invoking contempt jurisdiction of this court. Reserving liberty to avail such remedy, if he so wants, the contempt petition stands rejected at this stage.
