3. We have heard learned State counsel on I.A. No.01 of 2019, application for condonation of delay as well as on admission.

4. On due consideration, delay of 164 days in filing the CrMP is condoned. Accordingly, I.A. No.01 of 2019 is allowed.

5. The trial Court has acquitted the accused of the charges under Sections 363, 366 क, 376(2)(झ) of I.P.C and Section 6 of the Protection of Children from Sexual Offences, 2012.

6. Mere perusal of the statement of the prosecutrix PW-1, it is revealed that she has not supported the prosecution in relation to the allegation against the accused at any stage of her examination.

7. Considering the case of the prosecutrix, no case for grant of leave to appeal is made out.

8. In view of the above, CrMP deserves to be and is hereby dismissed.
