Proceedings through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 19/10/2020

1. By this Cr.M.P. the applicant seeks modification of the order dated 01.09.2020 passed by this Court in MCRC No.4610 of 2020 by which the bail application of the applicant was dismissed as withdrawn with liberty to revive the prayer after examination of the prosecutrix.

2. The applicant would submit that due to out break of COVID19 pandemic situation, the process of the trial has been

CRMP No. 1240 of 2020 stopped and presently there is no possibility to record the statement of the prosecutrix. The applicant sought a direction to the trial Court to record the statement of the prosecutrix within stipulated period.

3. Considering the fact situation of the case and particularly the fact that due to COVID-19 pandemic large number of trials are stranded, no such direction can be issued in any particular case ignoring all other cases which are also awaiting recommencement of trial.

4. Accordingly, the Cr.M.P. sans merit is liable to be and is hereby dismissed.
