Agrawal Order On Board 19/12/2019 (1) This petition has been filed against the order dated 24.05.2017 whereby learned Sessions Judge has allowed the application for exemption filed by respondent No. 1 in a proceedings under Section 498-A of the IPC.
(2) When the matter was taken up for hearing, learned counsel appearing for the petitioner would submit that main grievance of the petitioner is that the amount of maintenance already awarded to her is not being paid by respondent No. 1. (3) On the other hand, counsel for respondent No. 1 would submit that the respondent No. 1 is ready and willing to pay Rs. 1,60,000/- within a period of three days from today. (4) The aforesaid statement is taken on record.
(5) Having heard learned counsel appearing for the parties, having regard to the facts and
circumstances of the case, I do not find any merit in this petition warranting interference under Section 482 of the Cr.P.C., as the application filed by respondent No. 1 has rightly been considered and allowed by the revisional Court. However, as stated the amount of Rs.1,61,000/- will be deposited by respondent No. 1 on or before 6th January, 2020. However, for the balance amount, the petitioner is at liberty to proceed in accordance with law. (6) With the aforesaid observation, the Cr.M.P. stands finally disposed of. Sd/- (Sanjay K.
