1. The challenge in the present writ petition is to the order Annexure P-1 dated 26.06.2019 passed by the Collector, Balrampur.
2. This Court, at the outset, is of the opinion that since the remedy available to the petitioner under the rules is a second appeal before the Divisional Commissioner, the present writ petition in its present form is not maintainable.
3. Counsel for the petitioner, at this juncture, submits that the petitioner had approached the office of the second appellate authority and he was informed that the next sitting would be only on 26th of July and not before that, therefore, he has approached this Court.
4. This ground of the petitioner is not sufficient for entertaining the present writ petition bypassing the remedy of second appeal. The petitioner would be at liberty to approach the Commissioner and make a request for an early hearing of the matter taking into consideration the urgency.
5. With the aforesaid liberty, the present writ petition stands disposed of.
6. Subject to the petitioner furnishing photo copy of the impugned order, the certified copy of the same shall be returned to the petitioner.
7. Certified copy today.
