1. Heard.

2. This is a third application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.51/2020, registered at Police Station Singhanpuri Jungle, District - Kabirdham C.G. for the offence punishable under Section 20(a) of the NDPS Act.

3. The first bail application was dismissed on 03.12.2020 and thereafter the second bail application was dismissed on

MCRC No. 7010 of 2021 25.6.2021 reserving liberty in favour of the applicant to revive the prayer at an appropriate stage.

4. The applicant was found illicitly growing 20 cannabis plants weighing 16.6 kg . He is in jail since 09.8.2020.

5. Learned State counsel would oppose the prayer for grant of bail.

6. Considering that the applicant is in jail since last more than a year, I am inclined to release the applicant on bail.

7. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
