1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.430/2019 registered at Police Station City Kotwali, Mungeli, District Mungeli (CG) for the offence punishable under Sections 302, 307, 120-B, 212, 34 of the IPC.

3. The present applicant, juvenile Pavan Sahu and co-accused Zakir Khan along with other co-accused have allegedly thrown

MCRC No. 7475 of 2020 acid mixed petrol on deceased Om Prakash and lit him up with a match box in the evening of 2.7.2019, on account of which, he sustained severe burn injuries and eventually, succumbed to the injuries during treatment on 10.7.2019. The diary statement of the deceased was recorded on 6.7.2019. A dying declaration was also recorded on 10.7.2019.

4. Having seen the evidence available against the applicant, I am not inclined to release the applicant on regular bail.

5. Accordingly, the bail application is dismissed reserving liberty in favour of the applicant to repeat the prayer after examination of the remaining material witnesses.
